As of September 29, 2026
1. Provider and Scope
These General Terms and Conditions apply to all orders placed through the online shop at http://www.tinhof.at.
The provider and contracting party is:
Erwin Tinhof Winery
Owner: Dipl.-Ing. Erwin Tinhof
Gartengasse 8
7000 Eisenstadt, Austria
Telephone +43 (0) 2682 626 48
Email wein@tinhof.at
VAT number: ATU20809908
Agricultural holding number 4237242.
The online shop is intended exclusively for consumers within the meaning of the Consumer Protection Act who have a delivery address in Austria or Germany. Orders from businesses, resellers, and catering establishments are not processed through this shop; please contact us directly for such orders.
Any differing or supplementary agreements shall apply only if we have expressly confirmed them.
The language of the contract is German. These General Terms and Conditions are available for you to view, print, and save before placing your order.
2. Conclusion of the Contract
The presentation of the wines in the online shop does not constitute a binding offer, but rather an invitation for you to submit an offer.
You place the desired items in your shopping cart and proceed through the checkout process. On the review page before submitting your order, you can check all the information you have entered and correct it at any time using your browser’s or the shop’s correction tools. By clicking the “place order with obligation to pay” button, you submit a binding offer to enter into a purchase agreement.
We will promptly confirm receipt of your order by email. This confirmation of receipt does not yet constitute acceptance of your offer.
The purchase agreement is concluded as soon as we expressly confirm your order or dispatch the goods, but no later than five business days after receipt of your order. If we do not accept your offer within this period, you will no longer be bound by it; any payments already made will be refunded without delay.
We reserve the right to reject an order, particularly if a wine is no longer available.
3. Prices, shipping costs, and minimum order quantity
All prices are final prices in euros and include statutory VAT. For prepackaged products, we also indicate the unit price per liter.
The shipping costs will be displayed separately before you submit your order. The following rates apply:
Shipping country: Austria — free shipping on orders over €100.00
Free shipping to Germany on orders over €150.00
4. Payment
You can choose from the following payment methods:
Credit card — Your card will be charged [when the contract is concluded / when the goods are shipped].
Payment in advance by bank transfer — You will receive our bank details with the order confirmation. Please transfer the invoice amount within seven days, quoting the order number. We will ship the goods once payment has been received.
The purchase price is due for payment upon conclusion of the contract.
If a credit card charge cannot be processed for reasons attributable to you, we may request that you pay by bank transfer within a reasonable period or withdraw from the contract.
In the event of culpable late payment, we will charge statutory default interest at a rate of 4 percent per annum, as well as the necessary and appropriate debt collection costs.
5. Delivery
We deliver to Austria and Germany. Delivery to other countries is not available through the online shop.
Shipping is handled by DPD. Delivery usually takes 2–5 business days from the date the contract is concluded, or from receipt of payment if paying in advance. Any different delivery times are specified for the respective wine.
Alternatively, you can collect your order directly from the winery in Trausdorf by prior appointment. Please wait until we notify you that your order is ready for collection.
We will only make partial deliveries if this is reasonable for you and does not result in any additional costs.
The risk of accidental loss of or damage to the goods passes to you only upon delivery to you or to a person authorized by you to receive them. This also applies if we have arranged the shipment. If you have commissioned a carrier that we did not suggest to you, the risk passes to you as soon as the goods are handed over to that carrier.
Please notify us immediately of any externally visible shipping damage so that we can file a claim with the carrier. Your statutory rights remain unaffected and do not depend on such notification.
6. Retention of Title
The goods delivered shall remain our property until the purchase price has been paid in full.
7. Right of Withdrawal (Right of Revocation)
Cancellation Policy
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the goods. If multiple goods are ordered and delivered separately, the withdrawal period begins upon receipt of the last item delivered.
Exercise. To exercise your right of withdrawal, you must inform us
Erwin Tinhof Winery
Gartengasse 8
7000 Eisenstadt, Austria
Phone +43 (0) 2682 626 48
Email wein@tinhof.at
inform us of your decision by means of an unequivocal statement, for example by letter or email.
You can also exercise your right of withdrawal online. To do so, you can use the “Withdrawal” button in our online shop. It can be accessed without logging in and is available throughout the withdrawal period. If you use this function, we will promptly send you an acknowledgment of receipt on a durable medium, usually by email, containing information about the content of your withdrawal notice and the date and time it was received.
To meet the deadline, it is sufficient for you to send the declaration before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the date on which we receive your notice of withdrawal. This does not include any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option offered by us.
We will use the same payment method for the refund that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this refund.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods to the address specified above without undue delay and, in any event, no later than fourteen days from the date on which you notify us of your withdrawal. The deadline is met if you dispatch the goods before the deadline expires.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods if this loss in value results from handling the goods in a way that was not necessary to inspect their nature, characteristics, and functionality. Opening a bottle goes beyond such an inspection.
Exceptions
There is no right of withdrawal in the cases specified in Section 18 FAGG. As a rule, none of these exceptions applies to the wines offered in our online shop; therefore, the right of withdrawal generally applies without restriction.
8. Warranty
The statutory warranty provisions apply, in particular those of the Austrian Consumer Warranty Act and the Austrian General Civil Code. The warranty period is two years from the date of delivery. If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery.
If a wine is faulty, please contact us at wein@tinhof.at. To help us assess the issue, please keep the bottle, cork, and any remaining contents if possible; however, you are not required to do so, and your warranty rights do not depend on it.
Natural variations in color, aroma, and taste, as well as sediment formation in aged wines, are typical characteristics of a natural product and do not constitute a defect.
9. Liability
We accept unlimited liability for damage caused by us intentionally or through gross negligence.
In the event of a slightly negligent breach of a material contractual obligation, our liability shall be limited to the foreseeable loss typical of this type of contract at the time the contract was concluded. In all other respects, liability for slight negligence is excluded.
Liability under the Product Liability Act remains unaffected.
10. Protection of Minors
We sell alcoholic beverages exclusively to persons aged 18 or over. By placing your order, you confirm that you and, where applicable, the person you have designated as authorized to receive the order are at least 18 years old.
The delivery agent is authorized and instructed to hand over the goods only upon presentation of an official photo ID. If delivery is legitimately refused for this reason, you are required to reimburse us for the actual costs incurred as a result, in particular the delivery costs.
11. Choice of Law
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. This choice of law shall apply only insofar as it does not override mandatory consumer protection provisions of the country in which you have your habitual residence. For customers habitually resident in Germany, the mandatory provisions of German consumer law shall remain applicable.
12. Dispute Resolution
For the out-of-court settlement of disputes, you may contact the Internet Ombudsstelle, Ungargasse 64-66/3/404, 1030 Vienna, www.ombudsstelle.at, for assistance. We are willing to participate in dispute resolution proceedings before this body.
13. Data Protection
Information about how we process your personal data can be found in our Privacy Policy.
14. Final Provisions
Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
